Terms & Conditions

These terms and conditions govern the arrangement and delivery of services by Damaira ("we", "us", "our"), a home companionship and coordination service based at No. 134, Jalan Tun Abdul Razak, 80000 Johor Bahru, Johor, Malaysia. By engaging our services or submitting an enquiry, you ("the client", "the family") agree to these terms.

1. Nature of Our Services
Damaira provides three programmes: Family Coordination & Information, Social Engagement, and Daytime Companionship. All services are limited to companionship, household coordination, social activity arrangement, errand coordination, and family communication. We do not provide regulated personal care, medical attention, nursing, therapeutic, or clinical services of any kind.
Damaira is not a healthcare provider. Nothing in our service constitutes medical, therapeutic, or regulated professional advice.
2. Service Arrangements
A service arrangement begins when both parties have agreed in writing to the programme scope, schedule, and pricing. Written confirmation may be by email. The written support plan produced following the initial planning session forms part of the service record but is not in itself a binding contract — the binding terms are set out here.
We reserve the right to decline or discontinue a service arrangement where we reasonably believe it falls outside our scope of practice or where the arrangement would place our staff in an unsafe or inappropriate situation.
3. Pricing and Payment
Prices for each programme are as stated on our website and confirmed in writing before any arrangement begins. Current pricing is:
- Family Coordination & Information Service — RM 680 (one-time)
- Social Engagement Programme — RM 2,300 per month
- Daytime Companionship Programme — RM 3,600 per month
All stated prices are inclusive of the deliverables described in the programme description. Payment terms and methods will be confirmed at the time of arrangement. We reserve the right to review pricing with reasonable advance notice to existing clients.
4. Scheduling and Adjustments
Session days and times are agreed at the start of the arrangement. We ask for at least five working days' notice for any changes to the agreed schedule. We will endeavour to accommodate reasonable adjustments where possible.
In exceptional circumstances, we may need to substitute a companion. Where this occurs, we will notify the family in advance. We aim to keep substitutions to a minimum and will assign a companion familiar with the household wherever possible.
5. Termination
Either party may end a service arrangement with reasonable written notice. For monthly programmes, we ask for at least two weeks' written notice before the end of the current billing period. The Family Coordination service, being a one-time arrangement, is not subject to ongoing termination provisions.
We may terminate a service arrangement immediately where a family or household member acts in a manner that is unsafe, abusive, or incompatible with the wellbeing of our staff.
6. Scope Limitations
Clients agree that the following fall outside the scope of all Damaira programmes and should not be requested of our companions or coordinators:
- Administration of any medication or medical procedure
- Provision of personal hygiene or intimate care
- Financial management or handling of money beyond minor errand-related costs
- Making or attending appointments on a legally representative basis
- Overnight stays or unsupervised care beyond the agreed session times
7. Liability
Damaira takes reasonable care in the delivery of its services. However, we do not accept liability for incidents, accidents, or outcomes that arise from circumstances beyond our reasonable control, from the older relative's own choices or actions, or from conditions or risks not disclosed to us at the outset of the arrangement.
Nothing in these terms limits liability for death or personal injury caused by our negligence, or for fraud.
8. Confidentiality
We treat all household information, personal details, and service records as confidential. We will not share information about your family with third parties except as described in our Privacy Policy. We ask that families treat information shared by Damaira staff (including information about companions) with equivalent care.
9. Governing Law
These terms are governed by the laws of Malaysia. Any disputes arising from a service arrangement will be subject to the jurisdiction of the courts of Malaysia.
10. Changes to These Terms
We may update these terms from time to time. The current version will always be available on this page. Continued use of our services following a material update constitutes acceptance of the revised terms. We will notify active clients of significant changes directly.
